Terms of Use

Effective Date: 29 June 2025 at

1. Acceptance of Terms

By accessing or using the Thomas the Tank Engine Archive ("the Archive"), you acknowledge and agree to these Terms of Use and any applicable laws or regulations in your jurisdiction. If you do not accept these Terms, you are prohibited from using this website.

These Terms apply to all users regardless of location, and include additional protections required by major global data and consumer laws.

2. Non-Affiliation Notice

This Archive is a non-commercial, fan-curated repository not affiliated with, sponsored by, or endorsed by Mattel, HIT Entertainment, or any associated entities. All media, logos, trademarks, and characters are the property of their respective rights holders and are used here under fair use or fair dealing principles, where permitted by law.

3. Audience Restrictions

Access is prohibited for individuals acting on behalf of any organization or legal entity owning or enforcing rights related to the Thomas & Friends franchise. This includes, but is not limited to, Mattel, HIT Entertainment, or legal representatives thereof.

Exception: Private collectors, hobbyists, or fans not acting in an official capacity may access and use the site in accordance with these Terms.

4. User Rights and Restrictions

You may share public links to this site, including individual episode or collection pages. However, the following actions are strictly prohibited:

  • Accessing or sharing the underlying source URLs to hosted files (e.g. raw Google Drive links)
  • Using the Archive for any commercial, public, or profit-driven purpose
  • Scraping or downloading content for mass redistribution

Violations may result in removal of content and takedown requests by third parties, which we have no control over.

5. Purpose and Legal Context

This Archive is intended as a preservation and research tool. It exists to document media history for personal, educational, and non-commercial viewing. We recommend that visitors:

  • Own physical or legal copies of the media they are accessing
  • Use the site in jurisdictions that permit fan archiving under fair use or fair dealing

This site does not profit from any of its content and includes no monetization or advertising.

A legal disclaimer: While we formally discourage piracy and unauthorized use, enforcement is not our goal. This clause exists primarily to protect the Archive from takedown actions and to comply with applicable copyright frameworks (e.g. DMCA, EUCD, Berne Convention).

6. Community Policy

Users who choose to join the Archive’s Discord server or other affiliated communities must respect member privacy and refrain from publicizing internal messages, media, or discussions without consent.

9. Jurisdiction and Dispute Resolution

These Terms shall be interpreted under generally accepted principles of international law. In the event of a dispute, parties agree first to seek informal resolution via contact with the Archive maintainers. If needed, the dispute may be referred to the courts of the user's country or a mutually agreed jurisdiction.
